hentry\"><div class=\"entry-content\"><h3><span style=\"color: #9a2655;\">R\u00e9gime g\u00e9n\u00e9ral<\/span><\/h3><p>Le r\u00e9gime g\u00e9n\u00e9ral est d\u2019application pour tous les contrats de bail qui ne tombent pas sous l\u2019application des r\u00e9gimes particuliers. C\u2019est particuli\u00e8rement le cas pour le bail d\u2019habitation, le bail commercial ou le bail \u00e0 ferme. Lorsque la location rencontre certaines conditions, elle tombe en effet dans le domaine d\u2019application du bail d\u2019habitation, du bail commercial ou du bail \u00e0 ferme. Les parties ne peuvent dans ce cas pas opter pour un autre r\u00e9gime ou enlever de leur contrat des dispositions qui s\u2019\u00e9cartent des dispositions imp\u00e9ratives de la l\u00e9gislation relative au bail d\u2019habitation, du bail commercial ou du bail \u00e0 ferme.<\/p><p>Inversement, il est possible d\u2019incorporer \u00e0 un contrat ce qui est par exemple d\u2019application en mati\u00e8re de l\u00e9gislation relative au bail commercial bien que le bail en soi ne rel\u00e8ve pas de la l\u00e9gislation relative au bail commercial, mais bien du droit du bail g\u00e9n\u00e9ral. Les r\u00e8gles du droit du bail g\u00e9n\u00e9ral sont reprises dans les articles 1708 \u00e0 1762bis du Code civil et sont d\u2019application encas de location par exemple d\u2019espaces de bureaux, d\u2019espaces pour l\u2019exercice de professions lib\u00e9rales, de s\u00e9jours de vacances, de chambres d\u2019\u00e9tudiants, de lieux de stockage. Ces r\u00e8gles sont en outre d\u2019application de mani\u00e8re compl\u00e9mentaire pour les baux d\u2019habitation, commerciaux et \u00e0 ferme.<\/p><\/div><\/article><\/div><\/div>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-89d2ded elementor-widget-divider--view-line sc_fly_static elementor-widget elementor-widget-divider\" data-id=\"89d2ded\" data-element_type=\"widget\" data-widget_type=\"divider.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<div class=\"elementor-divider\">\n\t\t\t<span class=\"elementor-divider-separator\">\n\t\t\t\t\t\t<\/span>\n\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-12b13ce sc_fly_static elementor-widget elementor-widget-text-editor\" data-id=\"12b13ce\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div id=\"content-area\" class=\"clearfix\"><div id=\"left-area\"><article id=\"post-1899\" class=\"post-1899 page type-page status-publish hentry\"><div class=\"entry-content\"><h3><span style=\"color: #9a2655;\">Bail commercial<\/span><\/h3><p>Lorsqu\u2019il est envisag\u00e9 de conclure un contrat de bail commercial, le droit du bail commercial est d\u2019application. La l\u00e9gislation relative au bail commercial est, comme celle relative au bail d\u2019habitation, imp\u00e9rative. Cela signifie que les parties ne peuvent s\u2019en \u00e9carter (sauf si la loi le leur permet). S\u2019il est satisfait \u00e0 l\u2019ensemble des conditions pour consid\u00e9rer qu\u2019il s\u2019agit d\u2019un bail commercial, alors l\u2019application de la l\u00e9gislation relative au bail commercial ne peut pas \u00eatre exclue. Un contrat de bail doit \u00eatre conclu\/un loyer doit \u00eatre pay\u00e9 ;<br \/>2. En rapport avec un bien immobilier ou une partie de celui-ci ;<br \/>3. Qui sert \u00e0 l\u2019exercice d\u2019un commerce de d\u00e9tail ou l\u2019entreprise d\u2019un artisan qui est en contact direct avec le public;<br \/>4. Le bien doit lui \u00eatre principalement destin\u00e9;<br \/>5.
